Division of marital property

After the divorce, property division is the most unpleasant procedure for each of the spouses. In Article 69 of the Family Code of Ukraine established the right of spouses to divide the property, which is their joint property. With the concept of "joint ownership" there are many nuances, "What who owns and how to share it?"

Adopted three important decisions of the Plenum of HSCU:

- "On the application of civil procedural law in the revision of judicial decisions on newly discovered circumstances";

- "On practice of application by courts of the legislation when resolving disputes arising from credit relationships ";

- "On practice of application by courts Article 376 of the Civil Code of Ukraine (on the legal regime of unauthorized construction)."

In a letter dated 13.03.2012, № 25-111/581-2652 the NBU gave his explanation of what documents may require banks to open accounts of economic entities operating on the model ordinance.

Before making appropriate changes to the Instruction on the procedure of opening and closing accounts in national and foreign currencies, representative of a limited liability company which was established on the basis of the model statute, instead of a copy of the constituent documents (statute, constituent agreement, constituent act, provision), must submit a copy to the bank signed by all founders of the decision on its establishment, which shall include information on the name of society, its location, subject and purpose of the activities of the founders and participants, the amount of the authorized (shared) capital, the amount of shares of each of the participants, the order of their contribution, as well as information on the implementation of activities based on a model statute. In this case, a model statute by the representative of a limited liability company to a bank is not provided.
